Dream AV's terms and conditions of sale.
1. Pricing
All prices quoted are exclusive of VAT unless stated, which will be added
at the time of invoicing at the appropriate rate.
2. Credit Period
Goods are provided on cleared funds (cash, cheque or credit/debit cards)
with order terms, unless a credit account has been established. All credit
account invoices are payable net 28 days following invoice date.
3. Delivery
You/the customer take full responsibility for the goods once they have
been delivered and signed for. Before goods are signed for it is important
that they are checked for any signs of exterior damage, you are signing
to say they are delivered undamaged. In the event that the goods are signed
for unchecked or you suspect there may have been damage during transit,
this should be noted on the carriers delivery documentation at the time
of signing.
If the goods are found to not be fully functional when first
used and within 5 days of delivery, this is termed “dead on arrival”
and will be swapped out within a reasonable time period.
Dream AV should be notified if items are required to meet a certain deadline and are otherwise unwanted, so that we can request that the buyer pays for a timed delivery service (before noon, pre 10am etc), this acts as a fail safe against any delays in our couriers service and allows time to solve any delay issues.
4. Ownership of Goods / Retention of Title
The goods shall remain the property of Dream AV until paid for in full
by the Customer. The Customer agrees not to dispose or sell the goods
to any other party until payments has been made in full to Projected Image.
Should payment of the amount owing not be made when due, Projected Image
reserves the right to remove and repossess the goods (and for that purpose
shall be entitled to enter upon premises occupied by the Customer) in
addition to exercising such other rights or remedies as may be conferred
by law. In the event that goods are recovered in this manner, it is agreed
that the Customer will accept an invoice for an amount equal to the normal
hire charge for the period from the delivery date to the date of such
repossession, such amounts being payable in full forthwith.
5. Consequential Loss or Injury
Dream AV shall not be liable to the Customer for any personal injuries,
loss of profit, or any other indirect or consequential damage or loss
attributable to defects in the goods or otherwise in relation to the performance
of this contract. Furthermore the Customer shall indemnify Dream AV against
any claims for such damage or loss made against Dream AV by any third
party.
6. Warranty
The terms of the manufacturer’s warranty on goods sold will be stated
at the time of sale if required. 'Return to Base' warranty does not cover
cost of transportation to the designated repair location, nor does it
include a replacement unit whilst the repair is undertaken.
7. Projector Lamp units
For equipment sold, lamp units are the responsibility of the customer
and are not covered by the standard warranty issued with the projector and are covered by a seperate lamp (usually 90 days from date of purchase) warranty that reflects the lamps consumable nature.
